Why small Pelham Bay buildings still carry a mold duty
Pelham Bay is the coverage area's most evenly split housing market, and that trips owners up. A landlord with two apartments reasonably assumes the city mold regime is for large buildings, and for most purposes that is right. But 70.3 percent of occupied units here are rented, and the health department puts an owner of a building of any size under the duty to keep a home clear of mold and to repair the water problem underneath it where a tenant has been diagnosed with moderate or severe persistent asthma. In a neighborhood where the child asthma visit rate ran at 199.5 per 10,000 in 2023, that exception is not a rare case.

What a Pelham Bay owner should establish first
Start with two facts about your own building rather than with a contractor. Count the apartments, because three is where the annual inspection duty, the complaint response duty and the tenant notice begin, and ten is where outside licensees and city filings become compulsory. Then find out whether any tenant has a moderate or severe persistent asthma diagnosis on record, because that single fact can put a two family house under the same obligation as a tower. Owners who know both answers before an inspector arrives tend to correct within the class period. Owners who do not, tend to meet the escalation instead.
Three apartments is the first threshold
At that point an annual inspection of every unit, a response to complaints and a notice with the lease are duties rather than good practice.
An asthma diagnosis removes the size exemption
Where a tenant has moderate or severe persistent asthma, a building of any size carries the duty to clear the mold and repair the water behind it.
A vacancy is the cheapest time to fix it
Inside the city a vacant apartment has to be clean and clear of mold before the next tenant moves in, and an empty unit is far quicker to work in.

What Pelham Bay landlords ask about notices and duties
I own a two family house here. Am I really covered?
Not by the three unit rules, and not by the ten unit filing regime. You are covered where a tenant has a moderate or severe persistent asthma diagnosis, and in that situation the duty to keep the home clear of mold and repair the leak reads the same as it does for a large building.
The tenant says the basement damp is making them ill. What do I do first?
Respond in writing, then get the source found. We do not comment on anyone's health, and no contractor should. What an owner can do is document the complaint, have an independent assessor identify the moisture source, and correct the defect rather than repaint over it.
Tell us how many apartments you own here
That number, plus any asthma diagnosis on record, decides your duties.
